In November 2018, the California State Bar updated the Rules of Professional Conduct, which includes additional information on attorney websites and other communications primarily in the following areas:
Federal Law – On October 7, 2019 U.S. Supreme Court let stand a lower court ruling that all websites must be compliant with the Americans with Disabilities Act – Title III (42 U.S.C. 12181) This means website owners are obligated to ensure their website is accessible to all persons with cognitive, vision, hearing, and learning disabilities.
Fines up to $75,000 for the first violation and $150,000 for each subsequent violation.
California Law – California Civil Code Sections 51-52 states any violation of the ADA is considered a civil rights violation with a minimum statutory penalty of $4,000, plus attorney’s fees.
